Terms and conditions

For scaffolding services booked on tirongroup.com · Last updated: [date]

1. Scope

These terms apply to all scaffolding services of Tiron Group Ltd. ("we", "us") for businesses and private customers ("you"). Business customers' own terms do not apply unless we accept them in writing. Mandatory consumer protection law always remains unaffected.

2. Quote and contract

  1. The online configurator calculates a price from the information you enter.
  2. Binding offer (shown in the configurator as "Binding offer, instant"): the contract is concluded when you send the booking and the deposit is paid.
  3. Provisional offer (shown as "Checked within 24 h"): the contract is concluded when we confirm the booking by email. The deposit is only reserved on your payment method until then.
  4. Request (shown when an item is "on request", for example travel to Larnaca, Nicosia or Famagusta, with the button "Send request"): no contract is concluded and no payment is taken. We send you a complete offer, which you can accept.

3. Prices

  1. All item prices are net. VAT is added at the applicable rate. The total including VAT is shown before you book.
  2. The price consists of a base fee per order (transport from our yard in Paphos, loading, safety inspection at handover) and a price per m² of scaffold area, including erection, dismantling and 4 weeks of rental. Load class surcharges, longer rental and travel outside Paphos are listed separately.
  3. The price is based on your information. If the real scaffold area differs by more than 10 %, we adjust the price after measuring on site, up or down.

4. Deposit and payment

  1. A deposit of 20 % of the total is due when you book. It secures your erection date.
  2. The balance is invoiced at handover after erection and is due within 3 working days.
  3. Rental beyond the booked period is charged per m² and week at the price shown in your offer and invoiced after dismantling.

5. Cancellation by you

  1. Within 14 days of booking (conclusion of the contract) you can cancel free of charge. We refund the deposit in full.
  2. If, at the time you cancel within these 14 days, the erection date is less than 3 days away, we retain 10 % of the total price including VAT from the deposit, because planning and preparation have already started. We refund the rest of the deposit.
  3. After these 14 days the deposit is not refunded. We retain it as compensation for the reserved date and the planning carried out.
  4. Private customers also have the statutory right of withdrawal described in section 11. Where it applies, it takes precedence over this section. [lawyer: check the 10 % retention within the 14-day withdrawal period and the retention of the deposit after it for consumers]

6. Your obligations

7. Handover and safety package

We inspect the scaffold before handover and give you a signed handover record with photos. An inspection tag on the scaffold shows who erected it, when it was checked and which load class applies. Every booking also includes a template for your site risk assessment. Use of the scaffold is only permitted within the stated load class.

8. Date guarantee

If we do not start erecting your scaffold on the confirmed date, we reduce the net order value by 10 %. The guarantee does not apply if the delay is caused by:

We will inform you as early as possible about any delay. Further claims for delay remain subject to section 10. [lawyer: confirm wording and interaction with liability clause]

9. Rental period, extension and dismantling

The rental period starts on the day of erection. Please tell us at least [5] working days before the end of the rental period whether you need an extension. Dismantling takes place on a date agreed with you.

10. Liability

We are liable without limitation for intent, gross negligence and injury to life, body or health. For slight negligence we are only liable for the breach of essential contractual obligations and limited to the typical, foreseeable damage. [lawyer: adapt to Cyprus law and insurance cover]

11. Right of withdrawal for private customers

Right of withdrawal. If you book as a private customer (consumer) online, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded.

To exercise the right of withdrawal, inform us (Tiron Group Ltd., [address], [email], [phone]) of your decision with a clear statement, for example a letter or email. You may use the model form below, but you do not have to.

Effects of withdrawal. If you withdraw, we refund all payments received from you without undue delay and at the latest within 14 days, using the same means of payment. If you requested that the service begin during the withdrawal period, you pay an amount in proportion to the services provided until you informed us of the withdrawal.

Loss of the right. The right of withdrawal ends when the service has been fully performed, if performance started with your express prior consent and your acknowledgement that you lose the right of withdrawal once we have fully performed the contract.
